Starting at 2 pm on November 15, the Special Criminal Chamber of the Supreme Court will pass sentence on the youngest son of former President Alberto Fujimori, Kenji Fujimori Higuchifor allegedly negotiating illegally with the former president Peter Paul Kuczynski a humanitarian pardon for his father, who is serving sentences for crimes of corruption and serious human rights violations.
The Prosecutor’s Office has requested 12 years in effective prison for Kenji Fujimori, the former congressman Guillermo Bocangel and the former adviser Alexei Toledo by traffic offenses influence and bribery (promise a benefit in exchange for a vote) to the detriment of the State. The indictment also includes former congressman Welcome Ramirezfor whom 11 years in prison is requested.
According to the Prosecutor’s Office, Fujimori, his former adviser and his former parliamentary colleagues negotiated with the Kuczynski government to vote against a vacancy request in exchange for being granted the humanitarian pardon to Alberto Fujimori, at the end of 2017.
The vacancy request did not prosper with the votes of the Fujimori sector led by Kenji, although Kuczynski would later resign from office. On November 24, 2017, the Government granted a humanitarian pardon to Fujimori, a fact that also, months later, was annulled by the Judiciary.
The court composed of the supreme judges Inés Villa Bonilla, José Neyra Flores and Elizabeth Grossmann Casas He is scheduled to read a preview of the ruling today. In accordance with the Code of Criminal Procedure, the sentence will not begin to be served immediately, unless the court deems it necessary to guarantee compliance.
If there is no urgency, the penalty will become effective as soon as it is confirmed by the Permanent Criminal Chamber of the Supreme Court, presided over by Supreme Judge César San Martín Castro, in the last and final instance.
If things happen like this, it is possible that next Christmas two members of the Fujimori family — who ruled Peru between July 1990 and November 2021 — will spend the holidays in prison. Paradoxically, Kenji will not lose his freedom due to a complaint by political opponents, fighters against corruption or an ex officio investigation by the Public Ministry.
The process against Kenji Fujimori was initiated by the action of Fuerza Popular and his sister Keiko Fujimori, as he himself affirms. The late Fujimori congressman Moisés Mamani denounced that Kenji Fujimori had offered him a series of public works that would be prioritized by the Kuczynski government in exchange for voting against a vacancy request promoted by Fuerza Popular.
Kenji Fujimori and his former collaborators have defended that their actions and the accusation against them is politicalconsidering that they have not committed crimes and that there is no evidence against them.
“The damage and pain that my passage through politics has caused me is so much that I feel disappointed and disillusioned. I don’t want to know anything about politics, you can’t imagine the pain caused to my family, wife, daughter, parents, but especially to my mother, because since 2018 she was by my side in each of the sessions I attended and I was able to see how little by little his health deteriorated until his death”, affirmed the youngest son of the former dictator, when exposing his final arguments before the court.
“That Congress —I continue— wanted to disqualify me but could not achieve it. Today, the Prosecutor’s Office resumes Fuerza Popular’s objective of wanting to disqualify me. And now he seeks to illegally deprive me of my freedom, raising a thesis without any foundation. Since that date I do not belong to Fuerza Popular nor am I going to return to that political group that with bad arts has brought me here.
“None of the witnesses that the Prosecutor’s Office has presented in this trial, from a former president to state ministers, none incriminate me. (…) The actions presented by the Prosecutor’s Office do not match any criminal offence, they are indications that could not be confirmed at any stage of the process”, emphasized Kenji Fujimori.
For its part in its presentation, the Prosecutor’s Office stated that “it is fully demonstrated that Kenji FujimoriGuillermo Bocángel, Bienvenido Ramírez and Alexei Toledo offered the congressmen Moisés Mamani, Carlos Ticlla and Modesto Figueroa gifts and benefits so that they sell their public function and their function of control and sanction”.
The main evidence of the Prosecutor’s Office is the videos and audios recorded by Moisés Mamani and their transcription. It should be remembered that Mamani died a victim of COVID-19 in August 2020.
Keiko Fujimori also faces an accusation by the Special Team of Prosecutors in the Lava Jato case of 30 years in prison for the crime of money laundering. The case is in the accusation control stage and in the coming months, the Permanent Criminal Chamber of the Supreme Court will make a crucial decision for the development of the process.
